1. Introduction Welcome to the Surge Academy Affiliate Program! By signing up to be an Affiliate in the Surge Academy Affiliate Program (“Program”), you are agreeing to be bound by the following terms and conditions (“Terms of Service”). Surge Academy reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Program, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Program after any such changes shall constitute your consent to such changes.
2. Eligibility To be eligible to participate in this Program, you must be at least 18 years old and reside in a country where such participation is legal. You must provide your full legal name, a valid email address, and any other information requested in order to complete the signup process.
3. Enrollment Process To enroll in the Program, you must submit a completed Program application via our website. We will evaluate your application and notify you of its acceptance or rejection. We may reject your application if we determine that your site is unsuitable for the Program.
4. Affiliate Responsibilities As an Affiliate, you agree to promote Surge Academy products and services in a responsible and ethical manner. You will not engage in spamming, false advertising, or any other practices that may harm the reputation of Surge Academy.
5. Affiliate Links and Promotional Materials Upon acceptance into the Program, you will have access to Surge Academy banners, links, and other promotional materials. You may use these materials to promote Surge Academy on your website, email communications, and social media platforms, provided that you comply with our usage guidelines.
6. Commissions and Payments Affiliates will earn a commission on sales generated through their unique affiliate links. The commission rate varies per course. Payments are made on a monthly basis. Payments are made via PayPal.
7. Cookie Duration The cookie duration for tracking referrals is [45] days. If a potential customer returns to our site within this period and makes a purchase, the affiliate will receive credit for the sale.
8. Termination Either party may terminate this agreement at any time, with or without cause, by giving the other party written notice. Upon termination, you will cease all use of Surge Academy materials and remove all affiliate links from your site.
9. Intellectual Property All Surge Academy logos, trademarks, and promotional materials are the property of Surge Academy. Affiliates are granted a non-exclusive, revocable right to use these materials solely for the purpose of promoting Surge Academy.
10. Liability and Indemnification Surge Academy will not be liable for any indirect, special, or consequential damages arising in connection with this agreement. You agree to indemnify and hold harmless Surge Academy from any claims, damages, or expenses arising from your participation in the Program.
11. Confidentiality You agree not to disclose any confidential information received from Surge Academy, except as required by law, or with the prior written consent of Surge Academy.
12. Modification of Terms Surge Academy reserves the right to modify these terms and conditions at any time. You will be notified of any changes, and continued participation in the Program will constitute acceptance of the modified terms.
13. Governing Law This agreement shall be governed by the laws of Utah, without regard to its conflict of laws principles. Any disputes arising out of this agreement shall be resolved in the courts of Utah.
14. Miscellaneous This agreement constitutes the entire agreement between the parties. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure to enforce any provision of this agreement shall not be deemed a waiver of such provision.
